Apartment Safety Equipment, Surfacing and Shades

What is a Public Playground? “Public” playground equipment refers to equipment for use by children ages 6 months through 12 years in the playground areas of: Commercial (non-residential) child care facilities, Institutions, multiple family dwellings, such as apartment and condominium buildings, parks, such as city, state, and community maintained parks, restaurants, resorts and recreational developments, schools and other areas of public use.

If you operate a "Public Playground," it is critical that you protect the children by following these standards and guidelines. Ignorance of these guidelines does not protect you in the event of litigation. This includes providing the proper use zones, safety surfacing and shade protection in this area. In the unfortunate event that a child or children suffers an injury due to playing on a public playground which does not meet the standards, insurance companies will often opt out of covering claims, due to negligence.

This may leave the apartment or condominium management group, owners and/or employees legally liable for these claims, as well as the time and legal costs to defend themselves. For the protection of the children, as well as legal protection for your company and employees, we highly recommend that you provide the proper safety equipment, including shade and safety surfacing, for the entire use zone in the playground area.
